Atlanta attorney and client discuss crash injuries on national news

Attorney Jane Lamberti from The Cochran Firm Cleveland and her client Kay Bailey appeared on ABC News and Fox News. Bailey was injured in June while she was visiting the emergency room of an Atlanta hospital when a driver crashed through the entrance. 

Newly released footage shows the responsible driver crash into an SUV and then into the emergency room. Bailey was unable to avoid the oncoming car and was crushed. The accident left her with a broken pelvis and two broken hips. Atlanta police did not file any charges against the driver. 

The crash occurred on the morning of June 30. Since then, Bailey has gone through 3 weeks of intense treatment and physical therapy. She said she’s now walking on crutches, but can’t put weight on her right leg and experiences pain as she walks. Currently, Bailey is recovering while staying at home with her family. 

Lamberti said they are conducting a private legal investigation to determine to sue the driver or the hospital. 

The cause of the crash is still unknown. However, tests showed the driver was not under the influence of drugs or alcohol.

Lamberti said, “A hospital has a duty to maintain a secure area for everyone who approaches the hospital.” Suggesting that a protective barrier could have prevented the crash.

Lamberti added, “An emergency room is a high-traffic area. You are going to have people who are driving up that may be ill or confused. It’s foreseeable that they’re going to lose control of the car. At the same time, you have patients and pedestrians going in and out of the emergency room. You know this situation is going to be there and you must take steps to protect the pedestrians and the patients.”

The hospital shared their condolences for those hurt in the crash but made no comment to ongoing or potential lawsuits.

One potential safety solution and a talking point for Bailey’s case is the lack of concrete bollards at this entrance. Typically, bollards are placed in high traffic areas to mitigate damages from potential car accidents. You might see bollards placed in areas such as the boarding zone at the Cleveland Hopkins Airport.
