Medical Malpractice

Patients enter a hospital to work with medical professionals to better their health. Unfortunately, too often the opposite occurs. As a result, they leave worse than they arrive. The Journal of the American Medical Association lists medical negligence as the third leading cause of death in The United States. Medical malpractice occurs when a patient endures harm or injury because of a mistaken diagnosis. Also, improper treatment by a health care professional may cause injury. In the Mid-South, Medical malpractice may take place on the diagnosis, treatment, or after treatment levels.

Failure to diagnose occurs if a doctor’s diagnosis is incorrect. It can also happen when a patient is told they are not ill when they are. It is the responsibility of a doctor or heath care professional to correctly tell a patient what their illness is. If a doctor fails to diagnose a patient correctly, the patient might have a medical malpractice claim.

Improper treatment occurs if a doctor makes a proper diagnosis, but fails to treat the illness properly. This may cause the patient more harm than good. Therefore, improper treatment may lead to a medical malpractice claim.

Failure to warn patient of possible risks. Even proper treatment comes with potential risks. It is the duty of a doctor or other medical professional to inform a patient about the possible risks of a treatment or medication. If a patient is not aware of the potential harm or side effects that may occur as a result of medical attention, the patient may have a claim.
