California woman files personal injury lawsuit against maker of da Vinci Robotic Surgical System

Plaintiff’s attorneys claim negligence lead to serious injuries, death

A California woman is pressing forward with her personal injury lawsuit against the maker of the daVinci Surgical System, determined to hold the company accountable for the system’s defective design and construction. The product liability claim is the four such lawsuits to go to trial accusing the defendant, Intuitive Surgical, of putting patients at risk of severe injury, surgical revisions, and even death.

The 45-year old plaintiff once lived an active lifestyle before her doctor convinced her to undergo a hysterectomy with the da Vinci Robotic Surgical System. Instead of surgeons performing the procedure in the operating room, the system utilizes robotic arms with various attachments controlled by doctors to operate.

However, instead of decreased recovery time and minimal scarring promised by her doctor, the plaintiff suffered serious complications, including a perforated bowel which the plaintiff claims has permanently altered her life. Once an active mother of two, the plaintiff now claims she suffers from debilitating fatigue and discomfort as a result of the 11 corrective surgeries she underwent to alleviate her condition.
