Information About This Case

The Cochran Firm, DC is investigating claims that Dr. Javaid Perwaiz, a certified OB/GYN, was performing risky, unnecessary surgeries, including surgeries on unsuspecting patients from at least 2010 to October 2019 at two clinics in Chesapeake, Virginia, one in the Churchland area and another at and/or near the Chesapeake Regional Medical Center.

Dr. Perwaiz has recently been charged by Federal Prosecutors in the Eastern District of Virginia with Health Care Fraud and False Statements Relating to Healthcare Matters in connection with these surgeries. Prior to these charges, Dr. Perwaiz appeared to demonstrate a history of similar behavior. Dr. Parwaiz lost his hospital privileges at Maryview Hospital in Portsmouth, Virginia due to poor clinical judgment and for performing unnecessary surgeries in 1982. He had previously been investigated by the Virginia Board of Medicine for performing surgeries, predominantly hysterectomies, without appropriate medical indications and contrary to sound medical judgment. In 1996, Dr. Perwaiz pled guilty to two counts of tax evasion and had his medical license temporarily revoked before it was reinstated in 1998. He has been subject to at least eight malpractice lawsuits in which plaintiffs allege that he falsified patient records to justify a medical procedure, failed to use less invasive techniques, performed as many as 30 surgeries in one day, and provided substandard care that resulted in a number of irreparable, permanent, or life-threatening injuries.

Who is affected?

If you were a patient of Dr. Javaid Perwaiz and underwent any gynecological surgery, hysterectomy, hysteroscopy, cystectomy, or myomectomy, or if you believe you may have been operated on without your complete knowledge or consent, you may have a legal claim.

From at least 2010 to October 2019, Dr. Perwaiz is alleged to have knowingly and willfully executed a scheme to mislead his patients into unnecessary surgeries, even concealing from them additional surgical procedures in order to defraud the Virginia Medical Assistance Program (Medicaid) and other insurers. The surgeries Dr. Perwaiz performed can result in significant and life-long changes to a patient’s quality of life, and patients may be eligible for significant compensation.

What is a Hysterectomy?

Hysterectomies are major surgical operations that remove all or part of the uterus and can include the removal of the ovaries. A hysterectomy is performed when other treatments have not worked or are not possible, as there are major risks during such an operation, including infection, hemorrhaging during or after surgery, injuries to a patient's bowels, bladder, ureters, blood vessels, and other intra-abdominal organs, often requiring many more operations including colostomy, prolonged use of a bladder catheter, need and the risk of blood transfusion, as well as serious and at times lethal consequences of blood clots or thromboembolism.

The Allegations: Even when no complaints were made, and no tests provided any indication of a potential need, Dr. Perwaiz performed hysterectomies on patients which were unwarranted, unneeded, and dangerous. In addition, Dr. Perwaiz failed to inform his patients of the serious risks involved with such operations and did not always obtain their consent before operating.

What is a Hysteroscopy?

Hysteroscopies are medical procedures wherein a lighted tube is inserted into the vagina to examine the cervix and uterus, allowing doctors to look inside the uterus, typically to diagnose and treat causes of abnormal bleeding. Even properly performed, the procedure may cause pain, and typically the procedures can last between 5-10 minutes.

The Allegations: Dr. Perwaiz used poorly maintained and/or improper equipment, failed to properly administer anesthesia to his patients, and failed to properly perform the surgery - regularly taking only 5-10 seconds when no proper examination is possible in that time frame.

What is Cystectomy, and how does it differ from a Mastectomy?

A cyst is a sac-like pocket of membranous tissue that contains fluid, air, or other substances. There are a number of treatment options for cysts, and many cysts can resolve on their own following one or two menstrual cycles. A cystectomy is a major surgical operation that may remove the bladder and part of the urethra, along with nearby lymph nodes or abnormal cysts.

By contrast, a mastectomy is a surgical operation that removes fibroids, or cysts, while leaving the uterus in place. A physician may recommend a cystectomy or mastectomy surgery if a cyst is large, causing symptoms, or if cancer is suspected. The Allegations

Even when no complaints were made, and no tests provided any indication of a potential need, Dr. Perwaiz performed cystectomies and mastectomies on patients when it was clear that such a decision was unwarranted, unneeded, and dangerous.
