Jury Awards Victim $4.725M for Injuries Caused by Defective Ladder

Product liability lawsuit recovers compensation for injury victim

A Florida federal jury recently awarded a Broward County man almost $5 million in compensation over injuries he sustained after falling from a defectively manufactured step ladder. The claim, filed in U.S. District Court for the Southern District of Florida claimed Tricam Industries build the defective product which the Home Depot, also named in the lawsuit, sold to the plaintiff.

According to the product liability lawsuit, the plaintiff fell from the ladder while retrieving merchandise from the auto repair shop where he worked as a sales manager. The ladder allegedly buckled underneath the victim due to improperly installed rivets and holes in the device.

The jury awarded the plaintiff $2.3 million for past and future lost wages, $425,000 for past and future medical expenses, and $2 million for past and future pain and suffering. According to reports, Tricam Industries has been hit with other lawsuits over its Husky brand ladders over the very same complaints.

Dangerous product lawyers

Manufacturers owe a duty not to introduce potentially dangerous products into the stream of commerce. Usually, this involves a reasonable research and testing program to ensure the the product does not cause harm to consumers when used for its intended purpose.

Unfortunately, too many companies turn a blind eye to safety concerns these entities knew or should have known could exist. When this happens, victims can file injury lawsuits to recover compensation for lost wages, medical bills, and the pain and suffering of going through the ordeal.

Many defective products are produced by large, powerful corporations with experienced in-house counsel ready to deny, delay, and defend even the most egregious and obvious cases of negligence. Fortunately, the law gives victims the right to retain their own dangerous product lawyers to file a lawsuit and hold wrongdoers accountable.

Damages in personal injury claims can include:

  • All past and future lost income
  • Hospital bills and medical expenses
  • Additional medical treatment
  • Physical pain and suffering
  • Mental anguish

The amount and types of damages plaintiffs can recover for all depends on the circumstances of the particular case but an experienced injury attorney should have the resources and dedication necessary to ensure plaintiffs receive all due compensation.
