Nursing home injury lawsuits can help you get the compensation you deserveThe family of a Minnesota woman severely injured while under the care and supervision of an assisted living facility recently agreed to mediation talks with the operator to try and settle the nursing home injury lawsuit. The family filed suit earlier in 2016 and a hearing on the matter is slated for sometime next year.

The lawsuit names Provincial House and ProMedica Health Systems Inc. as defendants to the case, accusing them of negligently supervising the victim and violating the terms of her life care plan. The victim sustained her injuries after tripping on an electrical cord in her room while left alone.

According to the suit, the victim suffered multiple injuries including facial fractures, bruises, and a traumatic brain injury. The elderly woman had been left alone despite being deemed at high risk of falling in her life care assessment plan.

What is a nursing home life care plan?

Under the federal Nursing Home Reform Act, nursing homes and other assisted living facilities must comply with several regulations to ensure their residents are well taken care of. When a resident is hurt or dies because the nursing home failed to live up to these standards, victims and their family members may be able to file nursing home injury lawsuits to hold them accountable.

One of the most often violated provisions of the Nursing Home Reform Act is the adherence to a resident's life care plan. The plan is essentially an assessment of the individual’s health and safety needs which the nursing home will need to meet in order to maintain that resident’s well being.
